Credit cards debt joint spending but in my name!!!

Hi Can anyone give me some honest advice please?

I have about 25K of debt on various credit cards that are soley in my name! I know on a purly legal note they are my responsibility but if i go to court can a judge get her to pay anything towrds them? They are a true 50/50 spend and i have all the statements to prove this.

I would like to sell the house and pay off the debts simple 50/50. We have approx 35K equity so not alot and i have already paid 8K off of the debt since we split 2 years ago. Ive told her im willing to forget about this and still go 50/50!

My solicitors seem to be useless and im frustrated and worried im going to lend up having to pay all the debt and for her to still have all her half of the equity!!

Since she left i have paid all the mortgage and bills i have lived there on my own for this period she has moved out!

I have a child of 10 but she is not her mother so no ties there!

very frustrated and confused?? any advice would be greatly appreciated?

Welcome to Wikivorce, although IM sorry you have a need to be here.

What were the credit cards used to buy? If they were used for general family expenses, ie holidays, home improvements, food, etc then they would be classed as marital debt. As long as you can prove that the family/marriage benefited from the debt then you can reasonably argue that the CC debts should be a joint responsibility.
