What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

Firstly hi everyone!

Right here goes......

I was married for 7 years and then decided to get divorced due to my ex wifes unreasonable behaviour. We have two amazing children together.

I finalised the divorce on 1st jan 2011 DIY style.

When I left the relationship I carried on paying the joint loan we had together (both our names on the loan aggreement) and have never recieved any help with it from her. This loan has now been paid off in full. And she had all the family assets from the house (white goods etc) due to the children staying with her etc.

I have only just got round to trying to start sorting out a Clean Break order with her.

I am correct in believing that she is still responsible for the "debt" and it will be taken into account by a court when offsetting against my pension

Thanks very much

When you go for fdr they look at the total pot of assets and debts. If it is paid off then it isn''t in the pot.
