What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Okay, divorce petition just issued I''ve no intention of asking for her business or foreign properties to be taken into account, hoping for a ''Clean Break''.

Am currently unemployed.

I''ll only have to consider her assets if STBX comes after my pension and house (which are for the children).

So the questions are

1) I have cleared over £25k of debt (from the time we were together)which I can prove.

2) She has gotten herself further into debt in the same period (14k in unpaid taxes) and business has taken a nosedive.

3)STBX has advised she ''gave the foreign properties back to the developer'' after seperation. However 2 of her former clients have advised that she''s not and are willing to give this to me in writing (they were told by her that she is hiding them from me)

So question is; is new debt & cleared debt taken into account in the financials for divorce?

I should say at this stage that she has two failed businesses in her past, so anything she may get will be wasted and our children will not benefit.
