Hi

Has anyone had success using the court''s money claim service? I need to enforce a court order for costs.

Is it right that your fee is just added to the amount that you are owed?

How long does the process usually take?

Does your order for costs specify an amount or does it say "costs to be assessed if not agreed"?

Yes, the court fee is added to the debt so the paying party ends up paying that too subject to being able to obtain the monies.

The process is fairly swift although the courts are maxed out at present so the paperwork might be delayed.

Yes I have a specific amount. Ex is claiming that he can''t afford to pay it but he is a habitual liar. He said he would drip fed the amount monthly which I find totally unacceptable. He can easily afford to pay it. There is no due date on the order nor any guidance.

If the amount is specified you can enforce immediately. The default term for payment of a costs order is 14 days. If that has passed you can issue with moneyclaim online.
