What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

Joint Bank Account debt problem

When my now ex husband left in 2011, he froze 2 joint accounts. One was an account that he used and the other one with my bank. Both were in overdraft. He agreed by email to pay off the account more associated with him and I agreed to settle mine. I have been paying off ''my'' joint account debt monthly since.

However, I received a letter from ''his'' bank saying that the overdraft was over it''s limit. He has not been paying them. Obviously they would like their money and see it as a joint debt. I have asked them to write to him at his new address but they will not do this. I have advised them that we are divorced, emailed him about the debt and copied in the part of his email where he said he would settle the debt. He has not done this.

I would not like this to affect my credit rating and would welcome any help in this matter. Our divorce was a Clean Break - not sure if that is important. I have wondered if I paid the debt, if I could take him to small claims to recover it due to his promise to pay it. Thanks
