Hi,

Husband and I have recently separated, (my idea), one of the reasons being him running up £20K of debt behind my back. He has now got a debt management plan (not an IVA) and was just wondering if anyone knew if I would be jointly liable for the debt, since all the credit cards were in his name alone and the debt management plan is only in his name?

You are not liable for your husband's debts and they can not be enforced against you. They may be considered when it comes to dividing the marital finances though. I would suggest getting divorce proceedings and financial settlement underway, especially if there are assets he has an interest in and there is a risk of bankruptcy.

Thanks for your reply. He does have a share in our house but I was hoping if the debt management plan was in his name alone that it wouldn't be taken into account with any financial settlement. Suppose I just need to bite the bullet and get things moving legally now.
