Can someone tell me whether benefits are taken into consideration when assessing for legal aid ? WHen husband walked out in October I was on my miniscule wages and was told I was eligble, but now I have DLA and working tax credit with a disability element. Does that count as income as well ?

How will I possibly afford to pay if I dont get it ? I just dont understand.

I have DLA and have the letter in front of me so can tell you that all income is counted I also do have legal aid, eligibility will depend on all disposable income, If I remember rightly I think that your disposable monthly income cannot be more than £621.

oh thanks for that, does that apply to tax credit as well then ? And what does disposable income mean ? After bills are paid ? Because there isnt any left ! Also, what about money children give me ? Does all t hat come into it ?

ok that means I will definitely not be eligible then. So can anyone advise how much all this may cost then ?? How do you pay for it ? If I get everything, I wont have any money to pay for a solicitor ? I dont understand how I am going to be able to do this.
