Oh dear, my x2b wont be happy, as he is still living in MH my wage taken into account as joint finance when he applies for Legal Aid. I don’t qualify, so chances are he wont either. I know that he would have to pay Legal Aid back at the end of the day, but he cant afford to pay privately, or so he tells me, in order to file and now pay for the appointments he has already had with his solicitor. If he moves out, he will then probably be eligible. Nothing like being stuck between a rock and a hard place is there?

Are you sure ?

Your partner's income and capital are sometimes included, to be sure, but not if your partner is the person you are in dispute with.

Its what my solicitor has told me. I asked why his solicitors would want to see my last 3 months wage slips in relation to his application for Legal Aid. I provided these to my solicitor to work out my eligibility. She told me that as he was still living with me in the MH that my wages would be taken into consideration in his application. Only going on what my solicitor has told me, maybe its because my X2B is self employed and has basically lived off me.

I was going off the CAB website adviceguide which says more or less what I told you.

Unfortunately I don't work at a CAB any more and therefore can't consult their information system.

Can you ask them to check it ?

I will endeavour to get in touch with my local CAB to check. They are only open certain times and from what I recall when I was contemplating divorce following my X2Bs adulterous relationship, they only have one person who they prefer to advise and that person doesnt always work every week.
Thank you for your care and concern to point this out. At the end of the day, whether he gets Legal Aid or not, the end result will be divorce. I just feel so mad that I am the one who goes out to work to keep a roof over our heads, pays all the bills (utilities and groceries) and he does what he wants and keeps all monies he has for his pocket money.
Does make me want to have a gggrrrr !!!!!!!!
