What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

March 2010: Started legal procedings re Divorce & Ancillary Relief. Solicitor at that time wrongfully advised that i would not be entitled to Legal Aid as I had savings, even tho I was unemployed. So I paid privately.

APRIL 2011: Changed Solicitors, this new solicitor advised I may get Legal Aid as our savings where in dispute, (by this time i had started a temporay part time job).

July 2011: Legal Aid advised I was not entitled to legal aid re part-time work. So still continued to pay privately.

AUGUST 2011: My temp employment ceased. I was advised to reapply to Legal Aid ie change of circumstances. Still continued to pay privately until December 2011. (By now had paid out £10K).

DEC 2011: Was granted Legal Aid with contributions of £180 per month even tho was unemployed, I did query with them but they based this on yearly income even though I only had a temp 6 month contract)....I have to pay this from our disputed savings, as I have no other income and am not entitled to benfits re savings.

QUERY: I may have the chance of a part-time positon (albeit for about 2/3 months) which I would not like to decline. But I am not sure if it will be worth my while to accept position as Legal aid will stop Certificate & I will have to pay privately again (which will probably cost more than I earn) as before eg I earned total 4k & paid out 10K private legal fees.

LSC also take a long time to process forms and by the time they deal with my change (eg gaining employment), my contract of employment will have ceased and my circumstances will have changed again.!!! By which time I will have continued to pay out privately until they deal with ????

Hope this makes sense but dont know what to do. Solicitors say its not worth taking the job, but as I have been unemployed now for a year I would like to take up the offer of work.

What would you advise??? Jobs are hard to come by.

Thanks for reply.

If I don''t accept this post I will be removed from their temp list. As I live in a small town there are not many jobs., have been unemployed for nearly year and do not get job seekers living off savings & cb.. Other Side making a fuss bout me not working.

Next hearing early Sept.

Re. Legal aid.....
If my legal aid stops, & I have to pay privately , will I still have to pay stat charge at the end? , if so how is this worked out, what happens re the monthly payments I''m making now?

Lsc cannot give me information unless I send changes on relevant form cla4c

Grateful for some advice.
