Ex lied to get Legal Aid was created by Sas2017
My partner's divorce from his ex came through a few months ago, now he is going through a clean-break/financial settlement.

We've been told it will cost US between £4-6k but his ex (who is newly registered as disabled straight after working full time for many years) has been awarded Legal Aid on the basis that she experienced domestic violence.

This is not the case and subsequently we are angered and confused about how she managed to get it.

Our solicitor says the only way we'll find out is if we go to court and it's disclosed then but this is surely fraud and should be dealt with now, plus if it doesn't get to court we will never know how she got it.

Can we view her Legal Aid claim? Even just the parts that refer to my partner, does he has a right to information held against him?

I have come to the conclusion over the years that family law is a joke, it appears you can do anything you want and there are no consequences.

There have been times that I think my solicitor is representing my ex wife and not me.

I have proven that she has lied and made misrepresentation in various things, consequence or interest absolutely none. So good luck trying to get anything done.

No, there is no right to view the application. You can make representations to the Legal Aid Agency but essentially it is one word against another. You say the domestic violence did not occur whereas the wife says that it did. The Legal Aid Agency has already decided to offer legal aid and there is not a lot you can do about it.

Thanks for the replies, I thought Legal Aid was hard to get these days but obviously not, it makes us so cross.

She should have PROOF from what we read, police incidents, restraining orders etc..that why we wanted to see this so-called proof but it simply doesn't exist. My partners career would be over if there was such proof.

A simple letter from a GP saying historic episodes of DV occurred (read the claimant said it happened) within the last two years is all the LAA needs as proof.
