DIY divorce and form A was created by smellymoo
Briefly, I got a DIY divorce. I didn't seek any legal advice, and the total marriage duration from marriage to decree absolute is 2 years 5 months.

I didn't think the ex-wife could get anything once divorce is final, but we all know that was a mistake. I've received a form A. I now realise she can potentially keep coming back to do this. As part of dealing with the financial order application, can I request for a clean break, or must I handle it separately?

Additionally, I think she is asking for too much. She wants a 10k lump sum. She works, and being young with university education, has decent earning potential (I do earn more, however). I paid for everything during the marriage, and was barely able to save anything, until she vacated the property.

Insights, requests for additional information welcome.

Thanks for reading.

EDIT: Forgot to mention. No children. No properties. No pension. No investments, just a modest amount of cash.

Hello,
What proportion of the overall assets is £10k?
How much are you willing to pay her?
Has she instructed solicitors?
If so, £10k hardly seems worth the trouble and cost.

Hi

Thanks for your response.

She has not instructed solicitors. I don't really wish to pay much, if I am honest. The 10k is almost the entirety of my cash savings, depending to what extent entirely my \"belongings over 500\" count for (have a few high value items, some of which have much less value now than their original purchase price).

Form E's have not yet been exchanged, so I don't know exactly what she has.

I'm mostly interested to know if I can clean break as part of these proceedings, in order to avoid this again in the future.

I see, was there any cohabitation prior to the marriage? If so how long?

From the information you’ve given so far, I think a clean break would be likely.

I can’t think why you wouldn’t get a clean break. It’s a very short marriage and she is capable of supporting herself and there is no good reason you need to remain financially tied to each other.
