hi, since recieving a written report ( order ) from the judge covering our settlement,my ex has`nt bothered paying...i am worried that he may be trying to organise a trip with no return....possibly with our son....is it a fact that in the past fathers have had their passports removed from their possesion ?

Withdrawing someones passport is one of the new powers that the CSA can use against non-paying absent parents.

But it as a pretty last resort penalty and will not be done lightly.

I think it might also be possible to get the Passport confiscated if you had very strong evidence of a planned abduction...but as a parent your ex is entitled to take his son abroad so you would have to prove that he did not intend to return.

I don't think fathers have their passports confiscated if there is evidence abduction is planned. In exceptional cases the courts usually order the child's passport to be held by a solicitor.

Also if maintenance is the issue there are arrangements for the reciprocal enforcement of maintenance orders with many countries. Freedom of movement is fundamental human right and courts don't impose restrictions in all but the most serious of cases.
