hi all
im back again need a bit more help re MPS
ex has stopped monthly maintenance cheque
i was using this to pay for food petrol school uniforms etc
he has now also stopped payments into joint bank account
utilities, rates bills £1300 per month
accoutn is £10k overdrawn!

when preparing for MPS will it include my monthly bills from joint account which at min only being paid cos i have overdraft facility

will i be able to include my credit card payments which are due each month?

my mortgage is being paid by exs business, should i also include my mortgage in MPS
i have just paid 1k to have car serviced and new tyres can this be included?
does anyone know?

In short, yes!

Include all of these expenses. They are all real and all need to be paid.

He has shown that he cannot be relied upon to pay voluntarily.

MPS hearings are usually pretty straight forward.

Just show a clear itemised list of your outgoings. As long as they are all 'needs' and not wants then the judge will look to set a maintenance figure that keeps you afloat ..even if it hurts him...leaving him pretty broke in the short term.

thanks i am naturally very organised person and hold things together
however threats from ex about money every month and 10k overdraft have made me panic
was very disappointed that my sol wasnt very worried about all my direct debits and utilities as they were currently being paid by overdraft facility!
ridiculous especially as ex has a serious gambling addiction
i think its about time we got inot court and see what is really going on!
