What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi all
at moment have no income ex has stopped paying our bills and now no maintenance, he says as we are no longer married ( have nisi) he is not paying anything!
Preparing for Maintenance Pending Suit and Ancil Relief
However i am aware and have evidence of ex heavy gambling
£1000s per month!! Ouch!! Cheltenham Festival starts 2mor!

Will the judge take his ability to gamble and his funds to gamble into account when considering my MPS and his ability to pay me sufficient maintenance for our wonderful children.

What about the money he has spent in the last couple of years gambling will this be considered??

Any ideas or experience, I am getting deeper in debt whilst he blows his money on gigis

thanks 80s

If H is proved to waste serious money on gambling then it can be considered "conduct" -Court will add wasted £ back into pot and wasted £ will be part of H's settlement!!

thanks Atilla
Barrister did consider an injunction ages ago, but then backed down said was expensive and hard to prove, however at that stage ex was stil paying my bills

I will raise the possibility of an injuntion again.
It is reassuring to know that gambling will be taken into account, however I am now 18 months down the line and things are moving very slowly.
Will not give up hope have my fighting spirit back
thanks
