What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi,
I read on another site that Periodical Payments are intended to be child maintenance payments. Something that dawned on me, and this is not clear from the Final Order, is whether the Periodical Payments are in lieu or in addition to Child Maintenance? The Child Maintenance arrangement were in place via the CSA when the Final Order was made. There is no mention of Child Maintenance anywhere else on the Final Order.

Periodic payments can be made in favour of one spouse for the spouse''s benefit (spouse maintenance) or in favour of a parent for the benefit of a child (child maintenance.) If the order does''t stipulate the payments are for the benefit of the child it will be an order for spouse maintenance to be paid on top of child support through the CSA.
