does anyone have any advice about maintenance to spouse.? We were both retired but not drawing a pension as yet. He still gets money from his company. Do I get half his income? He is not working. I am 59 and he is 60. My job prospects are minimal .

Spousal maintenance basically depends on two things ; firstly your needs, and secondly his ability to meet or contribute to those needs.

You say you are retired but not drawing income. In low income cases the benefits issue can be very important and I''d always recommend a benefits check with a CAB, to ascertain your position now, and what it would be after separation.

At your age pensions are a very important consideration.

Without further information it is not easy to offer more than broad generalisations.
