I''m on Job seekers allowance and I claim for my partner. She also gets ctc and CB for our baby and we both get DLA. My stbx works in canada for minimum wage and actually has less income than me. Will I have to payher spousal support? we were married for 6 years and there were no children.

Sm is only payable if it is affordable and usually in cases where one income is considerably higher. It is possible you would be asked to pay nominal sm to leave the door open for a claim should you get a well paid job in future. However it was not a long marriage and there are no children so it is unlikely a court would order it. Have you agreed how to divide any assets of the marriage?

There were no assets really. The house was sold and just covered the mortgage. The car was almost worthless, so she kept that. She also kept all of the house contents and I don''t know what she did with them. We both took the debts that were in our own names, even though they were mostly marital debts - I took on more as she also had debts relating to her business that was going under.
Would an English court enforce a provincial Canadian Separation Agreement? From what I gather it won''t unless it was court ordered. I hope s as it states she gets $1000 a month - about 660 pounds!
