Update ;

Before the DJ 31st August 2012.
Upon hearing Counsel for both parties by telephone
IT IS ORDERED THAT-

and now for the good bit :)

the exh has to comply with the order made 28/6/12, provide all the information needed by the actuary and pay half the cost of preparing the report in respect of pension sharing.

He is also ordered to answer and supply full documentary evidence of the deficiencies in his reply to my request for information re his form E. This includes financial details of the OW who he bought a house with in joint names in 2004, prior to our divorce!

Costs to be reserved for the FH.

How I would love to be a fly on a certain wall this weekend ;)

Looks like dukey''s infamous donker stick has been borrowed by the DJ at this hearing! :laugh::laugh::laugh:

At my FH (2002) my x leave to appeal was refused which didn''t please him!

Am I right in thinking that although there was no pension share at the time of divorce it could be revisited seeing as my x has made an application for downward variation/ dismissal?

Application was put in some 2 weeks ago for consideration. I have not heard anything since. Will they inform me if the application is rejected?

Ho spooky,

Yes that is the case, my ex is furious & his solicitor was not upto date on the matter but pension sharing is now on the cards.
Have a read of this, wish my stupid ex had seen it and saved us both a shed load of money :(

This is not an appeal but an application to vary SM, these applications are rarely refused.

The court will let you know what information and what hearings will be required.

The application to vary SM cannot be used the change the capital agreement made back in 2002, it''s all about the maintenance if it should be paid stopped or varied.
