What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

No question about pensions is silly because they are so complicated and difficult.
You can have more than one pension - some people who have changed jobs a lot have 5 or 6.
A lot of people have the basic State pension and a pension from their job which they and their employer pay into and another pension that they just pay into themselves.

I am back soon

Suppose some body has more than one pension and he provides to the court information about only one pension. Can this be looked at or he can hide the information about the other pensions. If there is a way to find out please tell me.
Any information is very appreciated.

Hi Zozo,
All pensions are supposed to be disclosed, including any compensation payments. Disclosure is regarded as imperative but even sols can be devious in this area.....type McKay v Mckay in google...this was an appeal where the sol failed to disclose assets...the Court finding the sol wrong for "making decisions that are for the Courts to make!"...albeit it a Scottish action...it may help your question
Regards the way to get the opponent to discose....I am also interested in how to enforce this as I have been unable to get xtbs sol to disclose these after several letters over 3 years!

Most pension contributions are paid on a regular basis - so if it's a work based pension you'd see them on the payslips/P60 submitted with form E and payments to a personal pension would show up in the bank statements?
I don't know if a one off CETV transfer from another pension could be hidden but HMRC seem heavily involved in all aspects of pensions so it seems unlikely.
If anyone has found a way of salting away cash/pensions/assets so as to make them untraceable would they please let me know before my application to vary spousal maintenance?
I'm scared that my scrimping to gather a rainy day nest egg pension fund will be used against me to reduce my maintenance.
