What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Ok,

So I would start to decide what you are prepared to compromise on and what you are not.

Have you approached him about dividing things this way? Has he confirmed what he wants?

Be vigilant when offsetting equity against pension cash equivalent. Make sure it is not being done too unfairly. Be even more vigilant if you are offsetting and having a pension share.

To achieve equality of the income now and in the future will need to be considered carefully.

Once you know what each party wants and what can be achieved it is easier to decide how to approach the pensions and what assistance you may or may not need.
