I have recently received a copy of my husbands form E and it states a figure for the CETV of his pension. He already receives an ill health & an injury of duty pension from the Police. Is the CETV value based on both pensions or just on his ill health. I am already aware that I cannot make a claim on the IOD pension.

The CETV will be in relation to the ill health pension, not the injury on duty pension.

Does anyone know whether my ex will have his police ill health pension reduced when he reaches 65? My solicitor is trying to find out this information but its just taking so long. She says that if it is reduced then it may not be worth me applying for a pension share. My pension has been valued at 48K & his is 197K.
I would just like to get it sorted and apply for my Decree Absolute. Thanks for any advice.

No his ill health pension will not be reduced, the IoD pension may be reduced.

You have replied to my posts in the past.
I''d be interested to know your views on the following:

My solicitor has been trying to find out more about the CETV of my husband''s police pension. He currently gets an ill health & an injury of duty pension. The valuation given is £197K. My solicitor has confirmed that the figure quoted is not being drawn on & she believes that if a pension share is agreed that he would not immediately lose some of his income. I am confused by this as i was led to beleive that if i did get a share that his income would be affected.

Hi newjune,

If a pension is not in payment and becomes subject to a pension sharing order, the % shared is removed from the member of the pension scheme and transferred into a scheme for the other party,

The income of the member will not be affected though, no further contributions will be shared,

If the pension is in payment then the member will loose the % of the pension share.

I''m still confused by my solicitor telling me that the CETV valuation is not being drawn on yet my stbx is receiving an ill health & injury pension. Ian Conlon has advised me in the past that a pension share would definitely reduce my ex''s income immediately and yet my solicitor says it won''t. Confused.com!
