What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Please could someone help me on pension sharing date.
Our Decree Nisi was granted in February 2011. My stbx was still living in the family home at this time and moved out in July 2011.
Our case didn''t resolve at FDR, so we now have a date for Final Hearing. But the district judge indicated at FDR that our pension assets should be equalised. From what date does the pension equalisation take place?
My solicitor says we should only consider pensions earned during the marriage (not post matrimonal). My stbx got a new job shortly after our marriage ended. Does this pension get shared? I am still married to my husband and have been married for 22 years.
Our form E''s were prepared in April 2012 at which time my stbx and I acquired CETV''s for our pensions. So, do we share ALL our pensions up to today''s date, or up to separation date?
Our other financial assets are being shared as at form E date. Are pensions different?

It doesn''t really make much difference, if this ends at final hearing the judge will decide which will probably be the date of the hearing.

It''s not worth getting bogged down with this. Final hearing is the end to negotiation the judge decides.
