What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Many years after our divorce my husband has re-married and his new wife is badgering him to stop my pension share. Can he do this? I thought a pension sharing order made by the court at the divorce hearing was final!

When a pension is shared it is cut in two, you get one bit he keeps the other.

It can`t be changed after the fact so don`t worry.

If a pension share was ordered has it actually been actioned? You should hold the paperwork and it should now be your name.

I agree.

If you have a pension credit received from a pension sharing order then this is your pension in your name and under your control.

There is no ability for them to stop the payments.
