What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi,

Am very new to this, I currently live at the house which is owned by myself and my husband, we are only loking into divorce at the moment, but have separtated 7 months ago. My husband lives elsewhere, i stil live in the marital home with our 2 children aged 9 and 3 years.

Before divorcing we are looking at just selling the family home and we currently hae an equity of £100,00 now my husband wants 50 /50 . now i believe that as i am still iving there with the children that this is not fair.. Bit what is a resonable amount to offer him... ?

Without knowing more about your finances it is hard to answer.

Why not post:

Your income £
Husbands income £
Your pension CETV £
Husbands pension CETV
Savings £
other Assetts £

Your ages

Who will be the childrens main carer or will that be shared?

Normally whoever is named as the childrens main carer gets more of a percentage of asset value so 50:50 doesnt sound right.

Post back and someone will give you a clearer picture.
