Hi there, just wanted a bit of advice. I left my husband in April last year in our owned home (which is on joint names).My ex and my 6 year old daughter moved into his mums which is next door but one back in November (he has since abandoned out daughter to live with his new girlfriend who is heavily into drink and drugs) The house had a repossesion order at around the same time last year and to the best of my knowledge the house has since been repossessed. i found out a fortnight ago that the house has NOT been repossesed and my mortgage lender offered to let me carry on with the house and pay the arrears off monthly. My new partner and I thought this through and decided to move back into the property, I talked this through with my ex and he was fine about it at first now he is being really arkward and saying he will not sign it over. Is it possible I would obtain the house through the divorce as another reason I want to move back in is to build up the relationship with my daughter again as he did not let me hardly see her since I left in April. I am currently getting Legal Aid but I know that my ex has had his revoked and even owes them money. Does he have a leg to stand on as I know he wont be able to afford solicitors fees out of his own pocket.

Hi Dukey

Some answers for you...
We have been married so far for 6 and a half years...
Yes, our daughter was born after we were married..
My income is 15k, his is around 17k
He has not other assets apart from a pension with his employer but he claims there is some kind of clause in it to say I can't touch it...
