What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

We are just about to start divorce proceedings but we have an apartment in Spain which we have been trying to sell for the last 2 years!
We have drastically reduced the price in the last couple of days but bearing in mind how hugely complex we have found all legal stuff in Spain we were wondering if any one has any idea how we would be affected if our divorce completes before we have sold the flat. i.e. would it become much more complex if we are no longer Mr and Mrs

Hi TBone

The flat is a marital asset and as such will be added to the pot with all other assets and divided dureing AR after you have Decree Nisi.

So if it has not been sold or has and you have the cash makes no differance either way it will be split.

Thanks dukey
but what i really meant was does anyone know wether it makes things much more complicated in spain as they are so heavily into red tape if our marital status changes from what is on the title deeds
