What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi Wiki''s

Currently the joint owner (with ex) of two properties which are rented out and receive an income. To date I have vbeen receiving a portion of the rental income from ex (as the funds go into his bank account)

Ex has threatened to stop paying me. Judgment made at FH does not mention the rental income only that upon the sale of the FMH my interest in the properties will be transferred to him.

So surely until such time, my interest remains and therefore legally I am entitled to recieve the rental income.

I have written to his sol about this and threatened court action, but his sol says that under advice from council his position stands and he will not pay me.

What now? Any advice please?

Hi there Survive - can''t really offer any advice on this one, but just to say its not fair, its not right (understatement of the century!) but keep going, you have done so well to get this far. I know it doesn''t seem like it, but you must be nearer the end now than the beginning ..... surely

Although, maybe it never does end - no sign of CM for me this month - lol - nothing compared to your issues I know - just a minor irritant but sadly leopards never change their spots. If my ex was a nice guy, we would still be married

Keep going and make sure you take time out occasionally - easier said than done I know but you must look after yourself

x

Is there anything currently to say the money should be shared? For example what does the tenancy agreement say?

No, there isn''t. But we are joint owners, legally of the property so surely the rental income received should be shared equally?
Thanks
