What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

What can stbx do?

I''m separated with 2 young kids and living in the FMH. The mortgage & deeds are both in stbx''s name as were all the bills though I am paying them now in my sole name with stbx responsible for ground rent, rates (NI version of council tax) and mortgage. I receive no CM payments obviously.

Now I know the stbx wants me out and will not commit himself to any financial details as regards CM until I move out. Needless to say I''m loathe to move out and possibly find myself in a very bad financial position while he gets to stay in a decent house and pay me peanuts. At present he is renting, paying private CM to 1st ex and paying mortgage. Rent for me would be easily 3 times the CSA minimum guidelines so it''s a no brainer that I stay here as long as possible.

What possible underhanded tactics could he use to get me out e.g.

- declaring himself bankrupt
- having family buy him another property while he defaults on this one
- occupancy order
- some kind of compulsary sale order?

What effect would these things have on me & him? My worst fear is that he goes self-employed or declares himself bankrupt to minimise what he has to pay me but I know his family will support him financially so he''ll never lose out. It''s sad but given the last year, I have to presume the worst so hit me with the gory details folks :(

Thanks in advance.
