What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I am currently going through a divorce with the Decree Nisi in the next few weeks. I signed the house over to her for 15% of the equity and since then she has behaved appallingly and is currently cohabitting in the marital home for the past 6 months with her current boyfriend.

The Consent Order has not been approved.

Can I get another 15% when she sells up or our children are no longer dependant by way of the courts?

My solicitor says I have done myself no favours-obviously!

What re my options?

any help is much appreciated!!!

Regards,

Damien

As no Consent Order has been signed things can change, you may have a fight on your hands but nothing is set in stone.
