Hi there, I am separated but still live in our shared home where I pay 75% of the mortgage and all bills including service charge. I have just been made redundant and my partner has asked me to complete a Separation Agreement based on our sole asset which is a property in the north of England. We are selling the property as I cannot continue paying for it which will mean that I have no where to live.
In these circumstances does he have to pay the mortgage if I can''t and will the 50:50 financial split still apply? There are no children to consider.

We have been separated for 1 year and I have been paying 75% for the past three months prior to that it was 50:50 with me paying all the bills.

Any advice much appreciated! Thank you.

Are you married? The situation legally is very different depending on whether you are or not.
