What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Do you need help sorting out a fair financial settlement?

Our consultant service offers expert advice and support to help you reach agreement on a fair financial settlement quickly, and for less than a quarter of the cost of using a traditional high street solicitor.

Thank you Bobbinalong, it just seems like we are in a rut like nothing is going to happen.......it scares me to think that we will still be here in a few years time. The fact of whatever equity i get from the house, Legal Aid will take what''s owed back. Especially when i was told with the amount id probably get could be used on a deposit.

Camille, your case sounds so similar. I appreciate your stress - in exactly same situation since Feb and still NO sign of him moving out :(

Camille,
Why don''t you Petition him for divorce?
That is the only thing that moves anything forward, to lead you back to being an individual in your own financial right in law. That''s far more constructive than moving out.
Are either of you having an affair btw?
All the best
Pete

If you need to move out with your daughter to save your sanity then do it. I moved out with my teenagers into rented accomodation. Ex promptly moved his girlfriend and her son in. When I finally got him to court, judge ordered them out and us back in until my youngest is 21, when ill have to buy him out or give him his percentage. The affordable housing of the children is paramount.

Camille - providing you use the equity as a deposit to purchase a house, a charge can be put on the new house for the legal aid to eventually be paid back. So don''t worry about that.

I know, I was in that situation.

Hope this helps.

There seems to be an automatic assumption that he is going to move out on your say-so...The property is as much his as it is yours so the assumption is a little unfair.
