What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

My husband has said that he wants to buy me out. Our divorce is going through at the moment, I have just received the papers through to apply for the Decree Nisi. His girlfriend is going to buy my share of the property basically. My question is, do I need to deal with this now via Consent Order and filed with the Decree Nisi, or can I continue with the decree Nisi without it and deal with this in a a few months time? If I deal with the transfer of deeds later on, will it cost more, or could I have a problem legally?

The usual path of this process is that you completed the D8 and launch that with the courts once you both agree to the grounds of the divorce. The D8a is also sent in with your Petition. Once you have received your Nisi (meainng courts are happy to rubber stamp) then AFTER receving your Nisi you then enter intot he world of reviewing and attemtping to agree the financials. The Consent Order comes last alongside your Decree Absolute

Hope this helps, of course there are plenty of good folks here who will add their thoughs.

Kind Regards

DA

OK thanks DA, things are quite amicable between us, so don''t want to make a big issue out of it, just want to get this all done at the minimum cost possible.

If cost is a n issue take a look at the fixed price services that wiki offer, what they ask is what you pay not a penny more nor less.
