What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi there. Before I separated from my husband, I regretably added his name to my council tenancy. The tenancy was originally in my name only). I want to start divorce proceedings soon but the council have told me I need to ask for a property transfer order to be made at the same time as the divorce in order to remove my husband from the tenancy. They said this is the only way to get him removed from the tenancy. I want my son to be a successor to the tenancy but am aware that as things stand at the moment, if anything happens to me, my husband will have the right to live here. I separated from my husband in April 2007 and although I have an address for where he was living when we separated, I can''t say for sure he is still there as I haven''t had any contact with him for a few years. I would be very grateful for any advice you could give me. Thank you.
Regards,
Wendy
