Hi
Can i get a Consent Order without having to file for divorce.
My wife left me and the 2 kids but she said she does not want the house so i don''t have to sell but if i did sometime in the future she would like some sort of payment. I would like to get it written down legally so if she does change her mind or her affair goes pair shaped she cant come after me for half the house regards Edd.

You can only submit a Consent Order to court after the Nisi has been pronounced - so it''s done alongside the divorce process. You can''t have a sealed CO without having started a divorce.

If you aren''t planning to divorce for a while, you can get a Separation Agreement which will regulate your finances post separation and record the agreement you have made about the sharing/split of assets.

If it was done without your ex getting advise from a solicitor it would have little weight in the eyes of the law.

Better to get a divorce and the Consent Order sorted now.

What you want to happen to the house is called a "mesher order."

No it needs to be written and Implemented in the same way a Consent Order does, not the end of the world though as this site offers the service for £139
