What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Its now been 2 years Ive been separated by my ex. I left an abusive 18 yr marriage (was so broken down) and in denail and not eduacted on abuse. I finally hit my breaking point. We have 2 children together. I left at first but he agreed to vacate and let us return.
He did jail time after being convicted and charged with one count of physical assault on our son a second physical assault on myself and several breaches. Because of a plea bargain his orginal charge of sexual assault was reduced to common assault.
Just a history to share.
The matrimonial home just sold now we ae awaiting equalization.
I remained in the home until 7 mths ago as I said the house is now sold.

Can my ex charge me occupational rent when children lived in the home with me and I was unemployed for 21 mths of the time I lived in the home but with help was able to make all mtg payments while he never paid any mtg payments during our separation?
