Well a few missed mortgage payments and now they are starting legal proceedings to reposse the house. I''ve been out the property now 7months, paid mortgage for the first 3 months then nothing as I''ve being paying CSA. I know we are joint responsible for the property but I''m not allowed in and she has changed the locks to one door and leaves keys in the other ones. Anyone give me any advice what happens at court when the judge asks why I can''t pay mortgage anymore. I simply can''t afford to on my wages although I think the wife thinks I''m a millionaire the way she goes on. I''m not bothered about it getting repossed my credit ratings shot anyway. The wife can''t afford to pay for it but won''t sell even though they will be about 20k equity in it. I think she just want the honour of telling every one I made my kids homeless.

I''ve been there mate, same as you with a joint mortgage but not been in the house for 11 months now....has been close to repossession too. How far down the court process are you in relation to sorting out the finances?

It not started yet but the mortgage company are passing it to there legal team this month to commence soon.

Similar situation here (just no kids!) Have been out of the house for 3.5 years but my name is still on the mortgage because STBX cannot remortgage and now doesn''t even want to sell. I have no keys, he changed the locks only days after I left. Apparently he''s stopped paying the mortgage. There''s no way I can afford to pay the mortgage on his house (he moved back to his mother''s after two years) and rent on my current house.

I''ve told the mortgage company that I''m happy if it gets repossessed, I''m just waiting for them to actually take some action. Even at a low price we''ll only lose equity, it''ll still repay the loan.
