What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I have moved out of our joint mortgage house and I am living with my mum. I am willing to pay my half of the mortgage.
Do I have to pay the bills (gas, electric etc) as I am not living there?

welcome to Wikivorce.

Does your spouse work? Can they afford to pay the bills on their own? Can you afford to make a contribution towards them if they can''t afford all the bills in their entirety? How long ago did you move out?

Yes, he works and his salary is higher than mine. It''s just the utility bills that I''m wondering about really as I''m happy to pay my share of the things that need dividing up (mortgage, debts etc). I moved out 10 weeks ago so we''re going into our third month of separation and I haven''t been there at all. It seems reasonable to me that he takes on these bills?

Thanks for your help!

As he is working and has a higher salary than you, then it is reasonable for him to pay the utilities that he is using. You no longer live there and aren''t using any of the utilities and will have your own living expenses to meet.
