My STBXW and I have agreed that in order for her to have somewhere to live she will use her split of the assets as a deposit for a house. I will then take a mortgage for the rest of which the payments will form about 70% of the spousal maintenance. Ultimately the house should be hers.

How can I go about this? I assume the house will need to be in joint names as the bank won''t lend to me on a property that I don''t have a legal title to? Also where do I stand with regard to capital gains etc if I subsequently buy somewhere of my own? Would that be a second home and so liable for CGT if I sold it?

Couldn''t she just take a mortgage herself based on her income which included the SM you pay?

I didn''t know that SM could be used as income in a mortgage application. As it''d only be 12k a year she wouldn''t get much mortgage with that?
