What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Would like to know my entitlement to the marital home after a divorce that went through 18 years ago.

As pert of the resolution of the divorce, my understanding was that the property should not be sold without my prior knowledge.

Welcome to Wikivorce.

I take it there was no financial resolution at the time of the divorce? If so, why not?

Yes there was no financial resolution, as I had moved out of the marital home but my 2 sons were still living at the property.

I initially wanted to but my ex was claiming I was removing the roof over their heads.

So, there is no financial resolution.

I would like to ask some further questions.

1. Whose name is the marital home in ? Yours, hers, or both ?
2. Who is living there now ?
3. I am sorry to be a little forthright, but would you let me know the reasons who you have allowed the matter to drag on this long ? Because if I don''t ask the question, someone else will, so you might as well think about your answer.
4. What outcome do you want ?
5. Have either you or your ex re-married ?
