My ex husband left the matrimonial home 8 years ago and is now re-married, living abroad. He has paid little maintenance since he left. I have two dependent children and I have been advised by a solicitor that he has no longer any financial claim on the property.However, now my new partner has moved in, my ex-husband says he now has a valid claim on the former matrimonial home. Is this true?

Almost certainly not.

The first thing is that if your ex has re-married, his claim may well be barred for that reason.

But even if it isn''t I would say that his delay in making a claim would probably be fatal. Moving a new partner in would not in any event affect the issue one way or the other.
