What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Thanks for all your replies LMM.

I''ve just spoken to my current lender who have said that for her house it can have her on the title alone with a joint mortgage, with an indirect charge (an A2D?). So that''s good.

For myself they said that they have given 2 mortgages on different properties, for example in the case of children buying a house for an elderly parent. Of course the amount I can borrow is subject to their usual affordability criteria.

So I think we''ll continue down this path as it secures a home for her. I can rent for a few years and we can review after that. She is being reasonable in that she says she''ll take over paying the mortgage as soon as she can as she doesn''t want to be dependant on me forever.
