Hi

I have been reading up on a Mesher order or deferred charge as this is something I would like but my solicitor has told me my husband has to. Agree to it.

Will be starting divorce proceedings, 2 teenage boys oldest 17 youngest 15 I would like to stay in the family home until youngest is 18 to avoid disruption with schooling etc.
There is about £370k equity in property I would struggle to get a 3 bed property near to school would need to buy something for about £400k.

I wouldn’t afford a mortgage more than £100k over 12 years.

Any help would be appreciated.

Your solicitor has clearly based their advice knowing all the facts and figures and with a professional knowledge of the local courts.

Hard for anyone on here to comment without knowing ages, incomes and details of all assets.

How big is fmh and how much is it likely to sell for?

Can you afford to pay the mortgage and all the running costs from your income?

What will you do in three years to raise the money to pay your ex off?

Thanks for your reply in 3 years I would ask him to buy me out or we sell the house.

I’m 47, he is 49.
My income is £56k his is approx £45. Not sure of pension values but mine is probably larger.

FMH is 5 bed and wold sell for £600k approx.

I could afford to pay the mortgage and running costs from my income.

How much would a three bed house cost near you?

You may struggle to evidence that you need a house with two spare bedrooms and a £230k mortgage. Will your ex agree to it?

Why would a mortgage need to be over 12 years?

Where will your ex live whilst waiting for his share of the equity?

What other assets are there? Is a clean break not possible?
