For anyone else filling in a D11. Dont forget to put the case number from the divorce case on the paper work. I have just found this out and now need to resubmit the paperwork which will be sat in the divorce court queue for another 3 months.
My ex is still refusing to lower the asking price and I'd like to know the legalities of moving back into the fmh (for which I am on the deeds as joint owner).
I know this would :
a) likley mean I have a tax bill relating to her child benefit
b) mean she would probably lose some of her benefits as the household income would go up
c) mean stress and pain for all involved
What I want to know is, can I do it. Can I move back in. Or not.
I spoke to a solicitor about this. Their advice was against moving back in.
What else can I do?
At this point I'm very much out of options.
Can I for example go against the Financial Order and simply reduce the amount of child maintenance
im paying. She is not following the order, since if we are not in agreement on the sale of the fmh we should deferr to the court.
At the moment things are getting pretty tight finalcially. And I dont mean that I don't have enough cash to go to the pub every night. I'm running out of ways to save on food and other essentials.
If anyone has any advice that isn't just wait for it to sell or itll be over soon.. please let me know.
