Hello. Has anyone experience with a mesher order? If so may I ask if it impact on the husband getting his own new mortgage?
(We have a child aged 10.)
Or....a Friend of mine had a solicitor draw up a consent order...it says that her husband has to stay on the mortgage in name only but is absolved of any responsibility for payments. Plus he has his own mortgage too.
It's up to the lender if they'll release either party from a mortgage or not. A court can't force them do to so.
Again, it is up to the lender whether they will lend someone who is already on another mortgage money or not. A lot will depend upon income but usually it limits the range of lenders prepared to accept them and the amount they will lend.
