Good evening,

I have a draft consent order detailing sale of the house and a 50:50 equity split after costs. Fine.

However, with COVID-19, I may find it better to do an equity transfer and buy my ex-dragon out, I'd need a few months to get the funds together to buy her out though.

If I sign the consent order it is approved on the basis of sale of the house, what's involved later on if I decide to push on with an equity transfer?

You should see if you can get the order amended to allow the property to be transferred to you within an agreed period of time in consideration of a lump sum equivalent to 50% of the equity at the time of transfer (and release from any joint mortgage).

There should be a default order for sale to allow for the property to be sold and the proceeds divided equally if you are unable to meet the agreed deadline for buyout.

How would she rehouse if access to funds is delayed?
