What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi Carpet,

A private car number plate is realisable but its value on the open market may not reflect its worth to the current owner.

An unrealisable asset is strictly one which cannot be sold because there is no market for it. For example, a share in the freehold or lease of a property where by agreement the joint owners have contracted that there be no partial disposal to a party ouside of their agreement.

In such instance should the other joint owners refuse to buy the asset which is the minority share of the joint owner wishing to sell, and also refuse to sell their own shares, then the asset is at that time unrealisable.

Unrealisable assets still have value. They could also be a liability. Again taking the above example, the property could be owned on the basis of a fully repairing lease which has not been passed on to a tenant who has himself just gone bust.

just came across this by chance as i am trying to get two number plates valued - on advies from lawyer.
At one time we were offered 13500 for both the number plates but that was a few years ago.
There are two number plates here and husband wants to keep both.
I have no objection to him keeping them - as all i want out of any settlement is enough money to assist in buying a smaller home and number plates dont put a roofs over heads.
If these are unrealisable assets are they considered as worth nothing. My husband could sell these at some point and potentialy make a fair bit of money from them - should a value be put on these -
