Hello. I’ve just found out yesterday my wife is seing someone else after 24 yrs being together. We have been seperated since nov15th 2019. I was more or less forced out of my marital home and are now renting a flat. I pay the full mortgage on the house as well as all my other bills in the flat. I have one daughter who is 17 living there with my wife who goes too college . I wanted too go back too my wife maybe 2 months ago but she refused, so I had my suspicions then something was going on , but she was in denial. The truth is out now & I need sort my life out . I want too move back into my home & let her move out , go & live elsewhere with new boyfriend or her dads. She has commited adultery by law , so what are my rights . She said she would get the police too me if I tried move back in . What’s best thing to do anybody ?

What were the plans for the mortgage etc when you originally moved out which was long before you found out about the new relationship?

Is she working and able to pay the mortgage herself?

Where will your daughter live?

Your ex is unlikely to be in any rush to do anything whilst she is living rent and mortgage free in the former matrimonial home.

I’ve been told now by legal advise that I just pay child maintenance for my one daughter who lives with my wife . I have been paying since November half the mortgage as well but told by the solicitor I don’t have too , she should be paying it . She works & claims universal credits . I just want too make sure I’m right in refusing pay half the mortgage.

You are right that you do not have to pay the mortgage.

The problem is that if she cannot pay, or refuses to pay, then as far as the bank is concerned you are jointly responsible, so credit rating will be affected if payments are missed or the house is repossessed. If you continue to pay then aim to recover your capital payments for the mortgage from the date you moved out as part of the financial settlement.

I want too move back into my marital home next weekend . I’ve been seperated 6 months & been living temporary in a flat. The contract is up on the flat. It was only a verbal seperation too see how things go not being together. But she has moved on and is seing someone else now for 2 months approx . Can I by law as I have been told move back in & hope she moves out . Can she stop me & get the police . Just wanted no because I want my home back after living there 24 years . Any advise please
