What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi,

I am looking to change solictors but the current one has a divorce petition done on my behalf which hasnt been served yet. The new one says that if i cannot pay the existing solicitor(which i cant until i get my settlement)that he will not release my file and the new solicitor cannot get a copy of the petition from the court to serve it. There must be a way round this, does anyone know how?

Surely, if your divorce hasn''t been served yet, then the bill isn''t that big? Can you not scrape the money together, sell something, borrow from friends?

Thanks for your reply Elphie, the bill is nearly £10000 and yes no court work has been done yet, been trying for over a year to get a financial agreement (too long in my opinion)> Thats one of the reasons i want to change.I will have to challenge the bill but that will mean everything will be on hold whilst that is done.
