Hi
I have had to delay mediation due to no support from my solicitor
She has had all our financial disclosure forms along with my money since end of September
I have had no communication or up dates from her at all
I have sent 3 emails over the past 3-4 weeks with no response -so I phoned today -to be told she is on holiday.
I am getting grief from my ex re delay.
Where do i stand in order to get all my documents and money back?
I was made aware to contact her secretary tomorrow -but what can she do?
Can i ask for all my disclosure forms and money back -do they have any rights to refuse me?
I do not wish her now to represent me as i feel uncomfortable and unsupported by her
Can i complain to the law society? If I do not get my money back?
Any help and advice would be very grateful received x

I would ask for my paperwork back and the fees. Tell them you will be making a formal complaint. Use things like Professional misconduct, lack of communication, obligation between client and solicitor etc

You have nothing to lose

I was in a similar position which was why I self rep and only have Barrister for hearings.

Don't use a solicitor you're not happy with.

I will also say and this goes to everyone.

DO NOT stay with a solicitor that you are not happy with, No matter how far in you are.

I stuck with mine and it cost me a lot of money not only for his fees but loss of percentage at hearing.

I emailed solicitors and as my solicitor was on holiday another solicitor looked at my case -they could offer no explanation as to why after 7 weeks -she had not even looked at my f/d forms!! But hey i got my money back that was in account -so thank you for your advice

mediation starts Monday -so am going to go ahead without solicitors input as for an hopeful outcome- but previuos guidance through wikivorce has helped me with a realistic aim/outcome
Will probably post again for valuable advice re my expectations V's ex's offer
