Step-by step guidance for forms D84 and D80b

Hello,
I've had a look through the forum posts concerning forms D84 and D80b, and there's lots of great information on specific questions, etc...

But I was wondering if specific guidance for filling out these forms \"step by step\" is available anywhere, as form D186 is no help at all.

Also, does anyone know why the previous forms had brilliant guidance documents, then all of a sudden there seems to be nothing available?

I think I'm going to have to get a solicitor's help just filling out these apparently simple forms, but I'd prefer not to have to do that! :dry:

I should add that there are no children involved, it's not being contested in any way, and there are no finances or property splits involved.

Any help is much appreciated!

D84


In the (name of county court you are using) County Court

No of matter (use the case number from any other court form you have)

Between (petitioners full name) and (respondents full name) and (only use for adultery) Co respondent.


Application for directions for trial (Special procedure)

The petitioner (your full name) applies to the district judge bla bla bla

Signed (your signature) and add the petitioner is acting as litigant in person.


And thats it done

D80b when there are no kids;

1, Yes
2, No (unless the respondent asks and you agree)
3, Yes
4, No
5 (i) If still living together yes if not no.
5 (ii) Use the date you separated.
6 (i) No if you are separated.
6 (ii) Self explanatory
7 N/A
8 N/A
9 N/A


Last page
3 (i) Write the respondents signature as is written so if its J Bloggs don`t write Jane Bloggs
4 N/A
5 J Bloggs then the date


Sworn at (Lincon) county court
in the county of (what county is Lincon in :blink:)
this 21st day of November 2010

Thanks, dukey! Really appreciate it! B)I know most of the answers probably seem straightforward, it's just that the wording they asked for on previous forms was so particular, I didn't want to answer incorrectly and delay the process.

Thanks to you too, onamission! Don't know how I missed those examples of completed forms...thought I had looked pretty thoroughly on the HMCS website, but guess I didn't search properly. :dry:

Sorry...one more dumb question...it's ok to fill out these forms by hand, right? No need to complete them on the PC and then print? :-)

Hi Dukey.
Hope you can help me on Q5 & 6. Not sure what I should put as my answer.
In Q5:
5i) Is the respondent's behaviour as set out in your petition and particulars continuing? --> YES
ii) If the respondent's behaviour is not continuing, what was the date of the final incident relied upon by you in your petition? --> Should I write N/A???


Q6i) Since the date given in answer to question 5 or,if no date is given in answer to that question, since the date of the pettion, have you lived at the same address as the respondent for a period of more than 6 months, or for periods which together amount to more than 6 months? --> ** very confused** since the petition , in beg march, we are still living at the same address. What is the right thing to write? A month?? :S

ii) like above, self explanatory on sharing bedroom, meals etc.


Also. is there a time frame for me to return to the court with these forms to be sworn in?
